It is possible to take leave under FMLA (Family and Medical Leave Act) for mental health rehab if you or your immediate family member are dealing with a serious health condition that requires inpatient care or ongoing treatment by a healthcare provider.

To be eligible for FMLA mental health rehab, you must work for an employer covered by FMLA (this includes most public agencies, public and private elementary and secondary schools, and companies with 50 or more employees). You must have worked for the employer for at least 12 months and for at least 1,250 hours over the past 12 months.

Mental health conditions may qualify under FMLA if they call for residential or outpatient treatment by a healthcare provider. This can include conditions such as severe depression, anxiety disorders, bipolar disorder, and other SMIs (serious mental illnesses) that impair professional performance.

FMLA also allows for intermittent leave, which can be particularly useful if you are undergoing ongoing treatment that requires absence from work for periods of time but does not require a continuous 12-week leave.

During FMLA leave, your job is protected, meaning you can return to the same job or an equivalent one with the same pay, benefits, and terms and conditions of employment. Your health insurance coverage continues on the same terms as if you had continued to work.
